Only Rights Can Stop the Wrongs: Why Decriminalisation Matters

Kenya’s Penal Code does not outlaw the sale of sex itself, yet it criminalises activities around sex work — from “living on the earnings” to solicitation. In practice, these archaic provisions are used to harass, arrest and extort sex workers, driving the community away from health services and legal protection.

Decriminalisation means sex workers are more likely to report crimes, live without fear of violence, and access health and justice on equal terms. Through evidence, advocacy and strategic litigation, KESWA works for the removal of punitive laws so that sex workers are safer, healthier and free.
